The Mahima Institute of Ayurveda™ Online Program is made available by the Mahima Institute of Ayurveda™, founded by Dr. Zide Mooni.
The Mahima Institute of Ayurveda™ Practitioner Program is an online program and consists of content, a process, and a platform on which this program is made available (together called the “Program”).
The content (the “Content”) and inquiry process (the “Process”) used for this Program are provided to you by Mahima Institute of Ayurveda™ (“Mahima Institute”). The web-application and technical infrastructure (the “Platform”) on which this Program is made available to you (including the payment infrastructure) are provided to you by Mahima Institute of Ayurveda™. The terms and conditions in these General Terms of Service (“Terms of Service”) set forth the terms and conditions which govern your use of this Program.
Mahima Institute reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current service, including the release of new tools and resources, shall be subject to the terms of service. Continued use of the service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time at: www.mahimainstitute.com. Violation of any of the terms below will result in the termination of your account. You understand and agree that Mahima Institute is not responsible for the content posted, linked to or other included on or in the service. You agree to use the service at your own risk.
• You must be 18 years or older to enroll in the Program.
• You must be a human. Accounts registered by “bots” or other automated methods are not permitted.
• You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.
• You are responsible for maintaining the security of your account and password. Miami Institute cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
• You are responsible for all content posted and activity that occurs under your account (collectively, “content”) (even when content is posted by others who have access to your account).
• You must not post or allow any content that infringes other parties’ intellectual property rights or privacy or that violates any law or gives rise to any liability.
• If content from your Twitter or YouTube account or from any other website is posted, linked or included in your iPhone or Android application through the service, you represent and warrant that you have the right to allow such content to be posted or included therein.
• You may not use the service for any illegal or unauthorized purpose. You must not, in the use of the service, violate any laws in your jurisdiction (including but not limited to copyright laws).

2. Who may benefit from the program and what is it all intended for?
The Mahima Institute of Ayurveda™ Online Program is an online educational experience.
You must be eighteen (18) years or older to access the program. If you are under eighteen (18) years of age, you are not permitted to access this program for any reason. Due to the age restrictions for use of this program, no information obtained by or available through this program falls within the child online privacy act (COPA) and is not monitored as doing so. The main purpose of the program is to make the meditation”, a Mahima Institute–owned inquiry process, available to everyone by providing it over the web, to enable people to grow to their full potential.
3. What is the program not intended for?
The Program does not provide you with medical, financial or other professional counseling advice and is not intended as a substitute for the advice and/or supervision of professional services, consultation or supervision you may need.
4. Your responsibility in maintaining security and confidentiality of your account information
As part of the registration process and setting up an account, you will be asked to select a username and password to access the program. You acknowledge that you are entirely responsible for maintaining the security and confidentiality of your user name and password. Mahima Institute will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge or permission. However, you may be held liable for any losses incurred by Mahima Institute or another related party due to someone else using your account or password. Mahima Institute may provide limited and controlled access to private data you enter into the platform to technical personnel if and when a technical question arises regarding the functionality of the program. By accepting this agreement you acknowledge that you understand and agree with such limited access as described above.
5. Service and support
The program has been built using widely applied technologies such as web browsing, proprietary and open source media presentation technologies. Mahima Institute provides no guarantee relative to the operability of such services on any specific computer hardware and software platform.
6. Proprietary rights and confidential information
You acknowledge and agree that the program contains proprietary and confidential information that is protected by applicable intellectual property and other laws, and are the sole property of Mahima Institute and their licensors. The program is protected by copyright, trademark, patent, trade secret, international treaties and other proprietary rights, and also may have security components that protect digital information. Mahima Institute owns all intellectual property rights in the content and process, and the intellectual property rights in the platform. All rights in the program are reserved. You may not duplicate, copy, or distribute any portion of the program without prior express written permission from Mahima Institute.
No rights are being granted to you except for the limited license mentioned above.
7. Copyright policy
The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under the U.S. copyright law. If you believe in good faith that materials hosted by Mahima Institute infringe your copyright, you, or your agent may send to Mahima Institute a notice requesting that the material be removed or access to it be blocked. Any notification by a copyright owner or a person authorized to act on its behalf that fails to comply with requirements of the DMCA shall not be considered sufficient notice and shall not be deemed to confer upon Mahima Institute actual knowledge of facts or circumstances from which infringing material or acts are evident. If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, the DMCA permits you to send to Miami Institute a counter–notice. All notices and counter notices must meet the then current statutory requirements imposed by the DMCA; see http://www.loc.gov/copyright or 17 U.S.C 512(c)(3) for details.
You must provide Mahima Institute’s Copyright Agent with the following information in writing:
a) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
b) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
c) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;
d) Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail;
e) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
f) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

You agree that if you fail to comply with all of the requirements of this Section, your DMCA notice may not be valid.
We suggest that you consult your legal advisor before filing a notice or counter–notice. Also, be aware that there can be penalties for false claims under the DMCA.

Any links provided as part of the program have been provided as a convenience, but Mahima Institute does not control or endorse these linked websites, nor reviewed or approved the content which appears on the linked websites. Mahima Institute is not responsible for the legality, accuracy or inappropriate nature of any content, advertising, products or other materials on or available from any linked websites. You acknowledge and agree that Mahima Institute will not be held responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any of the links, content, goods or services available on or through the linked websites.
9. Disclaimer of warranties
The program is provided “as is”, “as available”, and without warranties of any kind implied or expressed, as to the accuracy, completeness, usefulness or appropriateness for any purpose. Mahima Institute does not endorse nor is responsible for the accuracy and reliability of any opinion, advice, or statement made on the platform by anyone other than an authorized Mahima Institute representative while acting in its official capacity.
10. Limitation of liability
Mahima Institute nor anyone officially representing Mahima Institute, is responsible or liable to you or anyone else for any damages, loss or injury relating in any way to
• The use of or inability to use the program made available;
• Any content contained on the platform;
• Statements or conduct posted or made publicly available on the platform;
• Any action taken in response to or as a result of any information available on the platform;
• Any damage caused by loss of access to, deletion of, failure to store, failure to back up, or alteration of any content on the platform;, or
• Any other matter relating to the use of the program
You agree to indemnify, defend, and hold Mahima Institute and their respective subsidiaries, affiliates, officers, directors, agents, co–branders or other partners, employees, and representatives harmless from and against any and all claims, damages, losses, costs or expenses (including reasonable attorneys’ fees and disbursements) which arise directly or indirectly out of or from:
• Your breach of this agreement,
• Any allegation that any materials that you submit to Mahima Institute or post on any forums (e.g., message boards, chat rooms) infringe or otherwise violate the copyright, trade secret, trademark or other intellectual property rights of a third party, and
• Your access or use of the program.
Mahima Institute reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Mahima Institute in asserting any available defenses.
This Section shall survive in the event this agreement is terminated for any reason.
This agreement shall remain in effect for as long as you continue to have access to the program. You agree that Mahima Institute, in its sole discretion, may terminate access to the program and the platform, in whole or in part, and remove and discard any content within the platform at the end of the stated program period.
13. General Information
The Mahima Institute of Ayurveda™ Practitioner Program is an online educational program designed to teach the student Self-Awareness which include the deeper aspects of the self in the physical, mental, and spiritual planes. It will teach and help the student take better care of their health through the knowledge of proper nutrition and lifestyle. By acquiring and implementing the study Ayurveda in the student’s life, her/she will be able to help those who are seeking help, including, family, friends, and clients.
Once the students complete the program, the student will be able to focus on health and disease prevention, counsel others on nutrition, oil therapies, the value of using different herbs, and client evaluations through online learning, clinical orientation and internship.
14. Prohibited Activities
In connection with your use of the program, you acknowledge and agree that you will not:
a) Copy, reverse engineer, reverse assemble, otherwise attempt to discover the source code, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell or distribute any information, software, products or services obtained through the program;
b) Access the program by any means other than through the standard industry–accepted or Mahima Institute–provided interfaces;
c) Transmit any message, information, data, text, software or image, or other content that is unlawful, harmful, threatening, abusive, harassing, tortuous, vulgar, obscene, libelous, or otherwise objectionable which may invade another’s right of privacy or publicity;
d) Impersonate any person or entity, including but without limitation, a Mahima Institute official, forum leader, chat room monitor, guide or host, or falsely state or otherwise misrepresent your affiliation with such a person or entity;
e) Post or transmit any material that contains a virus or corrupted data;
f) Delete any author attributions, legal notices or proprietary designations or labels that you upload to any communication feature;
g) Use of the program’s communications features in a manner that adversely affects the availability of its resources to other users (e.g., excessive shouting, use of all caps, or flooding continuous postings of repetitive text);
h) Post or transmit any unsolicited advertising, promotional materials, “junk mail”, “spam” “chain letters,” “pyramid schemes” or any other form of solicitation or any non–resume information such as opinions or notices, commercial or otherwise;
i)Violate any applicable local, state, national or international law;
j) Upload or transmit any material that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
k) Delete or revise any material posted by any other person or entity;
l) Manipulate or otherwise display the program by using framing or similar navigational technology;
m) Register, subscribe, attempt to register, attempt to subscribe, unsubscribe, or attempt to unsubscribe, any party, if you are not expressly authorized by such party to do so;
n) Use the program for any purpose that is unlawful or prohibited by these terms and conditions;
o) Use the program in any manner that could damage, disable, overburden or impair the platform or networks, or interfere with any other user’s use of the program;
p) Gain or attempt to gain unauthorized access to the program, accounts, computer systems or networks connected to the platform through hacking, password mining or any other means; and
q) Obtain or attempt to obtain any materials or information through any means not intentionally made available through the program.
15. General Conditions
a) Your use of the program is at your sole risk. The program is provided on an “as is” and “as available” basis.
b) Technical support is available from Mahima Institute only via email. The technical support email address is email@example.com
d) You must not modify, adapt or hack the program or platform or modify another website so as to falsely imply that it is associated with the program, Mahima Institute, or any other Mahima Institute service.
e) You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the program, use of the program, or access to the program or platform without the express prior written permission of Mahima Institute.
f) Mahima Institute may, but has no obligation to, remove accounts that Mahima Institute determines in its sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these terms of service.
g) Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Mahima Institute customer, employee, member, or officer will result in immediate account termination.
h)You understand that the technical processing and transmission of the Program, including your content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
i) You must not upload, post, host, or transmit unsolicited email, SMSs, or “spam” messages.
j) You must not transmit any worms or viruses or any code of a destructive nature.
k) Mahima Institute does not warrant that (i) the program and platform will meet your specific requirements, (ii) the program and platform will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the program will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the program or platform will meet your expectations, and (v) any errors in the program will be corrected.
l) You expressly understand and agree that Mahima Institute shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible (even if Mahima for Life Inc. have been advised of the possibility of such damages), resulting from: (I) The use or the inability to use the program; (II) The cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the program or platform; (III) Unauthorized access to or alteration of your transmissions or data; (IV) Statements or conduct of any third party on the program; (V) Or any other matter relating to the program and platform.
m) The law of the State of Florida governs these terms of service and any claim or dispute that you may have against Mahima Institute without regard to Florida’s conflict of laws rules, and the United Nations Convention on Contracts for the International Sale of Goods shall have no applicability. You further agree that any disputes or claims that you may have against Mahima Institute will be exclusively resolved by a court located in the city of Miami, Florida. You irrevocably consent to the express and exclusive venue and jurisdiction of such courts.
n) By agreeing to this agreement, you are:1) waiving claims that you might otherwise have against Mahima Institute based on the laws of other jurisdictions, including your own: (2) irrevocably consenting to the express and exclusive jurisdiction of, and venue in, state and federal courts located in the city of Miami in the state of Florida over any disputes or claims you have with us; and (3) submitting yourself to the personal jurisdiction of courts located in the city of Miami, Florida for the purpose of resolving any such disputes or claims
o) Mahima Institute may assign this contract at any time without notice to you. You may not assign this contract to anyone else.

Student Enrollment Agreement
1. In consideration of the following terms and conditions, the Mahima Institute agrees to:
Instruct and train Student in the methods and procedures for a specific Ayurvedic Educational Program called, Course Program -Ayurveda Level 1 – Ayurveda Wellness Counselor.
This Course Program (hereinafter “Certification Program”) will include in its curriculum:
• Nine courses: Mahima Institute will provide Student with the online materials necessary to complete each course: a study material/book or a chapter of the study book; a Power Point Presentation; a quiz; an experiential exercise guidelines; an assignment; and a “Student’s feedbacks” form. (Study material may change at the discretion of Mahima Institute if necessary to further improve the program.)
• A final online quiz and an assignment for a Final Research Paper.
• Up to 25 hours with a support member as a learning support.
• A thirty (30) hours Clinical Internship at Mahima Wellness Center with qualified and certified Ayurveda Clinicians, at the end of the program.
At graduation, students will receive the following:
• The Certification as an Ayurveda Wellness Counselor.
• A one year membership with Association of the Ayurvedic Professionals of North America (AAPNA).
• One (1) pre-packaged workshop* which includes a PowerPoint presentation.
• A set of inspirational cards “Maya Our Inner Reflections” By Zide Mooni
• A “Doshic Personality Profile & Lifestyle Assessment Guidelines.”
*it is the responsibility of the student to have the equipment necessary for the pre-packaged workshop (computer and projector).
2. Certification Program
Upon successful completion of the following items (see sections 2.1, 2.2, 2.3, 2.4, and 2.5), Student shall receive a “Ayurveda Wellness Counselor” diploma from Mahima Institute which is also approved by the Association of Ayurvedic Professionals in North America (AAPNA).
Studying of the home study course (study material/book or chapter of the study book and their corresponding Power Point Presentations), for the nine (9) requested courses – 180 hours
MIA 100 – Ayurveda History and Philosophy
MIA 101 – Understanding the Chakras
MIA 102 – Five Elements (Panchamahabhutas)/Prakriti
MIA 103 – Ayurvedic Physiology 1 – Understanding the Doshas
MIA 104 – Ayurvedic Physiology 2 – Understanding the Dhatus/Upadhatus
MIA 105 – Understanding Agni, Ojas, Tejas, Prana
MIA 106 – Introduction to Ayurvedic Nutrition/Dinacharya
MIA 107 – Introduction to Herbology
MIA 108 – Introduction to Panchakarma Therapies/Basic Diagnosis
Successful completion of the online quizzes, and other student assignments – 215 hours:
• One (1) online quiz per course that is nine (9) in total for the Certification Program.
• One (1) assignment for each course that is nine (9) in total for the Certification Program.
• One assignment for the “Doshic personality assessment practical”
• One (1) final exam and one (1) final assignment.
• One (1) assignment for each of the lecture/workshop/webinar, attended or viewed. A minimum of two lectures or workshops or webinar are requested, so that is two (2) assignments in total.
Practicing on a daily basis the experiential exercise – 135 hours.
Attendance at the prerequisite 30 hours Clinical Internship at Mahima Ayurveda and Acupuncture Wellness Center, in Miami, Florida. Attendance can be spread throughout 6 months, or could be done in a week. Attendance must be within three years of registering for the Certification Program.
Attendance or online viewing at two (2) of our Lecture, Workshop, or Webinar – 15 hours. Attendance must be within three years of registering for the Certification Program. An additional and optional 25 hours of Learning Support is offered to the Student to assist him/her in studying the program.
3. Student agrees to:
Pay the Mahima Institute the appropriate fees for the nine (9) courses, the 30 hours Clinical Internship being included in the Certification Program fees.
Complete and return all information requested for enrollment. Information requested include the acknowledgments of this Student Enrollment Agreement and the Terms and Conditions; and the Tuition Installment Plan Agreement with the Credit Card Authorization form, if applicable. Upon registration, the Student will receive an Enrollment Information form to be completed and sent prior to start the Certification Program.
Hold in confidence all confidential information (oral, online, and written) disclosed to him or her, by Mahima Institute during the term of this Agreement, including but not limited to marketing information as well as prices, discount and other business and financial data, regardless of form. Student will use such information or data and disclose it to others only to the minimum extent required in order for the Student to perform his or her obligation under this Agreement or under any applicable law or governmental, arbitral or court decision.
Graduate Student using the pre-packaged Workshop provided by Mahima Institute, will not modify it and will use it under the name of Mahima Institute.
4. Mahima Institute Clinical Internship Commitment Policy
The schedule of the Clinical Internship will be discussed between the assigned Support Member and the Student, once the 4th schedule will be then sent to the Student.
Students who are scheduled for the Clinical internship at Mahima Institute, need to advise the representative of the Institute, 3 days prior to a request of reschedule or cancellation.
Students who do not attend the Clinical Internship at Mahima Institute within 18 months of enrollment, unless an agreement has been made with Mahima Institute, will be removed from the active roster and put into a hold status. To re-enroll, students will be required to re-attend and complete all required quizzes and assignments of the Certification Program.
5. Term of Agreement
In addition, Mahima Institute shall have the right to terminate this Agreement, effective immediately, by providing written notice to the Student upon the occurrence of any of the following events:
Death or mental incapacity of Student;
Violation of any of the terms of this Agreement;
Refusal of completion of the quizzes, assignments or the two prerequisite lecture/workshop/webinar;
Non-payment of the Tuition Installment Plan Agreement unless a written agreement has been made with Mahima Institute Admission department.
A student who has been authorized a Leave of Absence, and he/she did not return on the scheduled return date.
Cancelation and Refund policy:
• All cancellation notifications must be done in written format such as a mail letter, e-mail, fax, or hand delivery for proper processing.
• All monies will be refunded if the applicant is not accepted by the Institute or if the student cancels within three (3) business days after signing the Enrollment Agreement and making an initial deposit.
• Cancellation after the third business day, but before the first course, will result in refund of all monies paid, with the exception of the non-refundable registration fee in the amount of $100.00 and the non-refundable membership registration fee with AAPNA in the amount of $150.00.
• Cancellation or withdrawal after receiving the first course, will result in no refund.
• Refunds will be made within 30 days of termination or receipt of cancellation notice.
Leave of Absence may be taken by the student for up to 2 years with a written notification and permission. Once the student commences class, he or she may start at the point where they took Leave. The student is still under obligation to make tuition payments unless other arrangements are made with the school.
There will be no refund of tuition, fees, charges or any other payment made to the Institute in the event the operation of the Institute is suspended at any time as a result of any “Act of God”, strike, riot, disruption, or for any other reasons beyond the control of the Institute
6. Confidential Information
Student acknowledges that in the course of this Agreement he will receive and/or generate confidential information. For the purpose of this Agreement, both sides acknowledge that all techniques and knowledge specifically developed by Dr. Zide Mooni, Swami Devakrsnananda and Mahima Institute staff for the “Doshic Personality Profile/Lifestyle Assessment Guidelines”, the experiential exercise guidelines, and the Clinical Internship shall be considered confidential. The parties acknowledge that other information that is passed between the parties but which has not been disclosed to the general public shall also be deemed confidential.
Upon the termination of this Agreement, Student shall surrender any such information it has in any tangible form to Mahima Institute.
Both parties acknowledge that Mahima Institute will be irreparably harmed by a breach of this Section 6, and, that because such harm cannot be adequately compensated by monetary damages the most appropriate remedy shall be an injunction or other appropriate equitable relief to enjoin dissemination of confidential information.
7. Mahima Institute Trademarks and Trade names
Except as expressly stated herein, Student shall have no right to use any Mahima Institute trademark or trade name. Both parties acknowledge that Student’s breach of this Section 7 will cause irreparable harm to Mahima Institute which cannot be adequately compensated by monetary damages and, accordingly, Mahima Institute shall be entitled to an injunction or other appropriate equitable relief in order to enforce the provisions of this Section.
8. Unauthorized Representations
Student shall not act as an agent for Mahima Institute or misrepresent Mahima Institute in any manner.
9. Relationship Between the Parties
The relationship between Mahima Institute and Student during the term of this Agreement shall be one of independent contracting parties.
10. Governing Law
This Agreement shall be governed in accordance with the laws of the Miami Dade County, Florida, USA.
11. Limitation of Liability
Mahima Institute’s liability, and Student’s sole remedy, shall be limited to the return of any monies charged the Student.
Any notice required hereunder shall be deemed effective if given in writing and sent (a) by registered mail, postage prepaid, or (b) by cable or fax to the other party at the address indicated in the first paragraph of this Agreement, or to such other address as may have been specified by such other party in writing for the receipt of notices directed to it.
If it is found that any portion or portions of this Agreement violates, or is invalid under, the laws of the United States, any state, local or other legally constituted authority, or any governmental or executive order or regulation, at the option of Mahima Institute this Agreement may be terminated forthwith by written notice, or such portion or portions may be declared of no force or effect and this Agreement construed as though such portion or portions had not been inserted herein, and the remaining Agreement shall remain in full force and effect.
15. Entire Agreement
This Agreement constitutes the entire Agreement between Mahima Institute of Ayurveda and Integrative Medicine and the Student, superseding any prior agreement. No modifications of the Agreement shall be binding unless in writing and signed by Student and an authorized representative of Mahima Institute. Once signed and accepted by Mahima Institute, this Agreement shall be legally binding on both parties. In witness whereof, the parties have executed this Agreement. My signature below certifies that I have read, understood and agreed to my rights and responsibilities and that the institution’s commitment and refund policies have been clearly explained to me.
MAHIMA INSTITUTE OF AYURVEDA™ is a registered mark
